If Developer fails to deliver your flat / apartment in scheduled time and is reluctant to interest of the money deposited by theHome Buyer then the grieved home buyer can now approach Lok Adalats to the faster redressal . Since the civil courts in India takes years to deliver judgement therefore Law Ministry has allowed to include Housing in public utility services so that the matter related to Housing flats / Delay in possession delivery or other disputes with the developer can be resolved at Lok Adalats.
A Union law ministry notification, that was released on Feb 16, stated the 2 new groups happen to be incorporated in Section 22 A from the Legal Services Government bodies Act, 1987 “in public places interest”. According to feedback received by legal services government bodies across the nation, the federal government has added “education or educational facilitiesInch and “housing and property services” under the phrase ‘public utility services’ which may be included in lok adalats. Until now, ‘public utility service’ meant for transport services, postal, telegraph or phone number service, energy and water supply service, sanitation, service supplied by hospital or dispensary and insurance service.Since the housing & Property related services are now added to this , so all the disputes between Home buyer & Builders will be covered in this act.
“This can reduce pendency in regular courts. Issues like qualifications for admission, exorbitant tuition, refusal or delay to allow degree, refusal by builder to pay interest, Unreasonable Hidden charges, lack of quality in delivered housing project and most importantly the matters pertaining to the delay in possession of housing flats etc could now be included in lok adalats where grievance redressal is quicker than regular courts,” described a senior official from the law ministry. The Legal Services Authority Act was passed to constitute legal services government bodies to supply free legal services towards the less strong parts of the society and also to organise lok adalats to make sure that the whole process of the legislation encourages justice on the foundation of equal chance.
This step of the Union Government is seen as a big relief to the home buyers who used to be hesitant to go to the court to seek justice against Developers who are undeterred of legal consequences and have become habitual of making unreasonable delay in possession delivery of Flats in their housing projects.
